Almost every time there is a motor vehicle accident in Boise, a traffic rule has been violated. These rules include traveling too fast for conditions, breaking the speed limit, and failure to yield at a stop sign. Of course, these are just examples, and there are many, many more. The police are generally summoned to an accident and conduct an investigation. Most of the time, the police officer determines who is at fault for the accident. The officer then issues a citation to the offending driver. These citations are discretionary to the police officer, and, at times, the officer does not issue a citation though he or she may note in the police report that a certain driver violated a traffic rule.

Although it is important to know whether or not a person is issued a citation, a traffic violation may still have occurred in the absence of one being issued. It is not necessary that the police office actually write a ticket to the driver in order to establish that the driver was at fault for the accident.
