The Idaho Department of Lands has issued a preliminary order approving an encroachment permit for a client who installed rip rap and a boat ramp adjacent to Bear Lake, Idaho.

The application was aggressively opposed by a neighboring landowner. However, after a two day trial, the Department of Lands approved the application in full.

John Goodell and Dan Green last week concluded settlement with recovery of $25,000 for “Client,” a large international engineering and construction firm and original contractor, and which provided extensive engineering management and procurement services, at a substantial but acceptable discount, arising from  long running state court mechanic’s lien complex litigation, with bankruptcy detour, relating to Hoku Materials plant construction failed project.

John Goodell has made a settlement for “Client” in total amount of $65,000 (on total account debt of $71,000  P+I), with $50,000 initial payment to be paid by cashier’s check sent via overnight mail today for receipt tomorrow, and three additional $5000 installments due 1/1/16, 2/1/16, and 3/1/16, in account collection case, in Bozeman, MT action.  John Bulger assisted as licensed MT counsel.

Racine Olson partner Richard Hearn, M.D., prevailed both as a lawyer representing Jennie McCormack and his own challenge as an Idaho licensed physician to the constitutionality of Idaho’s laws regulated abortions. In a unanimous opinion authored by Judge Pregerson, the Ninth Circuit found that most of Idaho’s laws regulating a women’s right to choose were facially unconstitutional.

Daniel Green and Brett Cahoon from the Racine Firm attended the 33rd Annual Bankruptcy Seminar this year in Boise, Idaho. Mr. Green, who is nationally certified in business bankruptcy law and creditor’s rights, has attended over 25 of the 33 annual seminars. The seminar is sponsored by the Idaho State Bar Commercial Law & Bankruptcy Section, and focusses on the latest issues in the areas of Bankruptcy and Creditor’s Rights law. Topics covered at the seminar included discharging student debt in bankruptcy, medical indigency liens, homeowners associations and bankruptcy issues, defective security agreements, and bankruptcy proofing settlement agreements in non-bankruptcy litigation.
