Idaho State Police are continuing to investigate a multi-vehicle accident that occurred on Thursday, August 28th. The accident took place on I15, at mile 93, just before 3:30 p.m.
The accident involved three vehicles. The first, a red Toyota Avalon, was being driven by a 21-year-old from Rexburg. As he traveled southbound, he began to hydroplane, due to excess water on the roadway. He collided with the barrier, before striking the second vehicle, a blue Dodge Ram pulling an RV, driven by a 20-year-old man from Utah. The Dodge was then pushed into the third vehicle, a Kenworth Semi, driven by a 63-year-old man from Rigby.
The driver of the Toyota was transported to a local hospital for treatment of his injuries. The other drivers were checked and treated at the scene. All three individuals wore seatbelts at the time of the accident.
We send well wishes to the injured driver, and hope he will make a speedy recovery.
Unfortunately, according to Idaho Transportation Department’s crash report in 2023, multiple vehicle crashes accounted for 72% of all motor vehicle crashes in 2023, leaving a total of 19,807 multi-vehicle crashes. Of that total, 151 of those crashes resulted in fatality, and 594 caused serious injury.
LIABILTIY FOR ACCIDENTS IN IDAHO
No one who gets into or drives a vehicle wants to be involved in an accident. But unfortunately, car accidents happen. Idaho uses a fault-based system to impose liability on the party most at-fault for the accident. A legal principle called “comparative negligence,” is applied to determine the negligence of all involved parties. If the Plaintiff’s negligence is less than 50%, then she generally can recover damages from the Defendant (or the Defendant’s insurance policy).
Our personal injury attorneys can advise injured persons about their particular case and how Idaho’s legal principles of negligence, causation, and liability apply to it.
