At approximately 5:45 p.m. on December 14th, two vehicles traveling on US 93 exited the roadway. The incident occurred in Jerome, Idaho, at mile 64.
At the time of the incident, the first individual, a 43-year-old woman from Twin Falls, was driving a 2022 Audi Q5 northbound. When she reached mile 64, she veered into the southbound lane, facing oncoming traffic. The second driver, a 65-year-old man from Cottonwood Heights, Utah, driving a 2024 Freightliner Cascadia, was traveling southbound when the Audi entered his lane. Both drivers swerved before exiting the roadway, and continued onto the eastbound shoulder.
Following the incident, the driver of the Audi was transported to a local hospital via life flight. Reports include that she was wearing a seatbelt at the time, however she sustained severe injuries. The driver of the Freightliner was uninjured.
Several days later, on December 29th, the 43-year-old driver of the Audi succumbed to her injuries in the hospital.
Unfortunately, according to Idaho Transportation Department’s crash report in 2023, multiple vehicle crashes accounted for 72% of all motor vehicle crashes in 2023, leaving a total of 19,807 multi-vehicle crashes. Of that total, 151 of those crashes resulted in fatality, and 594 caused serious injury.
LIABILTIY FOR ACCIDENTS IN IDAHO
No one who gets into or drives a vehicle wants to be involved in an accident. But unfortunately, car accidents happen. Idaho uses a fault-based system to impose liability on the party most at-fault for the accident. A legal principle called “comparative negligence,” is applied to determine the negligence of all involved parties. If the Plaintiff’s negligence is less than 50%, then she generally can recover damages from the Defendant (or the Defendant’s insurance policy).
