Lewis and Mallory Mitton<\/p>\n<p dir=\"LTR\" align=\"LEFT\">The general public\u2019s ideas about the legal system are often shaped by TV shows such as <i>Law and Order: SVU, The Good Wife, <\/i>and <i>Fairly Legal<\/i>. The plaintiffs and defendants in these fictional courtrooms are enemies who battle it out using any means necessary to win. These are highly sensationalized and exaggerated representations of what really occurs in criminal cases and civil litigation. In contrast, worker\u2019s compensation proceedings should not be like this at all. The entire purpose behind worker\u2019s compensation laws is to get injured workers fair compensation for their injuries. It has been said that worker\u2019s compensation cases are&#8221; nice guy law&#8221; where all the parties need to act civility and politeness. The junkyard dog approach will not be tolerated.<\/p>\n<p dir=\"LTR\" align=\"LEFT\"><span style=\"font-family: Calibri; font-size: medium;\"><span style=\"font-family: Calibri; font-size: medium;\">The definition of &#8220;nice guy law&#8221; is illustrated in the 2016 Idaho Industrial Commission decision <\/span><\/span><a href=\"http:\/\/www.iic.idaho.gov\/decisions\/2016\/03_16\/salinas_v_bridgeview_estates.pdf\"><i><span style=\"color: #0000ff; font-family: Calibri; font-size: medium;\"><span style=\"color: #0000ff; font-family: Calibri; font-size: medium;\"><span style=\"color: #0000ff; font-family: Calibri; font-size: medium;\"><span lang=\"EN\">Salinas v. Bridgeview Estates<\/span><\/span><\/span><\/span><\/i><\/a><i><span style=\"font-family: Calibri; font-size: medium;\"><span style=\"font-family: Calibri; font-size: medium;\"><span lang=\"EN\">.<\/span><\/span><\/span><\/i><span style=\"font-family: Calibri; font-size: medium;\"><span style=\"font-family: Calibri; font-size: medium;\"> The Commission states &#8220;\u2026the \u2018no-holds-barred\u2019 mentality which is often a part of civil litigation has no place in workers\u2019 compensation proceedings. Unlike civil litigation, which is truly an adversarial-based process, the goal of workers\u2019 compensation \u2013 to provide an injured employee with those statutory benefits to which the worker is entitled \u2013 should be shared by all parties&#8221;.
