    Mr. Warr is Of Counsel with Racine Olson Nye Budget and Bailey, Chartered practicing in the firm's Boise office. His practice focuses on commercial real estate, complex financing, loan workouts, commercial turn-arounds and restructuring. Mr. Warr began his career in private practice focusing on real estate, planning and zoning and commercial financing issues. In 2004 Mr. Warr started as in-house counsel for the DBSI Group of Companies (.DBSI.) in Boise, Idaho. He has continued to represent DBSI throughout a bankruptcy liquidation that is the largest-ever court directed real estate liquidation involving an Idaho company. Since the petition filing in 2008 Mr. Warr has represented the Chapter 11 debtor-in-possession, the Chapter 11 Trustee and the subsequently appointed Liquidating Trustee and Litigation Trustee.

    EXPERIENCE:

    • Represents Liquidating Trustee in major real estate and securities company undergoing Chapter 11 bankruptcy liquidation (designated .mega-bankruptcy. status by the Delaware bankruptcy court) handling numerous real estate loan workouts and real property liquidations for over 800 affiliated entities. Also involved in management and litigation of over 900 avoidance actions and other related litigation and represents Trustee(s) in all Idaho actions.

    • Lead counsel for the acquisition of approximately 300 commercial properties in 35 states from 2004 through 2008, with total value in excess of $2.6 billion.

    • Lead counsel in negotiation and documentation of over 200 commercial real estate loans (both conduit and portfolio loans) from 2004 through 2008 totaling in excess of $1.5 billion.

    • Senior in-house counsel for SEC inquiries related to tenant-in-common real estate structures for large real estate and securities sponsor working closely with Washington D.C. securities counsel and the former chairman of the U.S. Securities and Exchange Commission.

    • Lead counsel for stock acquisition and leveraged buyout of gas station, convenience store and fast-food restaurant chain valued in excess of $30 million.

    • Developed strategic alliance relationship for real estate sales between a national commercial real estate seller and developer and the country.s largest commercial real estate firms.

    • Served as a Commissioner on the Twin Falls City Planning & Zoning Commission for 3 1/2 years, serving as Chairman of that Commission for approximately 1 ½ years.
