Practice Summary:
Mr. Byington has a broad range of commercial lending experience, including secured and unsecured financing. He assists lenders in all phases of the lending process, including the initial structuring and drafting of commitments, the negotiating and finalizing of loan documents, and closing. Mr. Byington provides opinion letters on the enforceability of loan documents. He has successfully negotiated and implemented workouts and restructures of distressed and nonperforming loans. He has also represented creditors in judicial and non-judicial foreclosures of both personal property and real property.
Mr. Byington has extensive experience in mergers and acquisitions, representing both sellers and purchasers. His practice includes a variety of commercial transactions, including the negotiation and preparation of merger and acquisition agreements, property purchase and sale agreements, confidentiality agreements, letters of intent, leases, options, loan agreements, intercreditor agreements, promissory notes, guaranty agreements, assignments, security agreements, deeds of trust, mortgages, and forbearance agreements.
Mr. Byington has structured and closed numerous deals. Representative transactions include:

Academic Degrees:
Mr. Byington obtained Bachelor of Science Degrees in Finance and Economics from Utah State University in 2001. He earned his Juris Doctorate Degree at the University of Idaho College of Law, where he graduated summa cum laude in 2004.
Professional Memberships and Activities:
Mr. Byington is a member of the Idaho State Bar and the Utah State Bar. While attending the University of Idaho College of Law, Mr. Byington served as an associate member and technical editor of the Idaho Law Review. After law school, Mr. Byington served as a law clerk to Chief Justice Linda Copple Trout of the Idaho Supreme Court. Mr. Byington authored How to Make Your Appellate Brief More Readable, published in the July 2005 edition of The Advocate, the official Idaho State Bar monthly magazine.
